OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of: The employer is failing to prevent employee exposure to struck-by hazards near the spin area. On or about September, 27, 2019, employees were exposed to ejected workpieces during the spin process. The employer fabricated racks to hold workpieces, to include 54 inch long by 1.5 inch diameter anchor bolts, upright during the zinc galvanizing process. The racks consisted of 4.5 inch diameter bar about 5 feet tall affixed to a circular base 2.5 feet in diameter. The rack included two rings affixed to the central bar and were located about 15 inches and 35 inches when measured from the circular base. The workpieces were inserted through the two rings and rested on the circular base. The rack was attached to a 4-ton pneumatic mechanism to spin the rack to remove excess galvanizing material from the workpiece. An uphoistman suffered fatal struck-by injuries when a rack ejected a 54 inch by 1.5 inch diameter anchor bolt during the spin process. Abatement documentation is required for this violation.
