29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. (a) On or about September 16, 2019, the employer modified the Toyota forklift SN 75664 in that an attachment was added to lift a 705 pound coil of steel with a single metal mesh sling over one fork of the Toyota forklift truck so employees could load the decoiler machine in the flange department without ensuring that the capacity, operation, tags, etc were changed accordingly. (b) On or about September 25, 2019, the employer provided three pairs of fork extensions for employees to use with any of the five Toyota forklifts to lift split coils that were used in the stamper, flange and spiral departments without ensuring that the capacity, operation, tags, etc., were changed accordingly. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
