29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection: (a) On or about September 16, 2019, at building #6, the employer failed to ensure the employee was protected from a fall hazard to the ground below. The guardrail/railing on the balcony on the 3rd floor was not maintained. The guardrail could not withstand 200 pound force from any outward direction. Employees was exposed to a fall hazard of approximately 20 feet to the ground below. (b) On or about September 16, 2019, at building #6, the employer failed to ensure the employee was protected from a fall hazard to the ground below. There was no guardrail/railing installed on the second floor balcony. Employee was exposed to a fall hazard of approximately 10 feet to the ground below.
