OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards. a) 8 Estate Street, Christiansted, VI. Batch plant operations yard On or about September 6, 2019, employees engaged in warehousing activities are exposed to crush-by while operating Power Industrial Trucks. Among other methods, feasible and acceptable methods to correct this hazardous condition would be: 1. Adhere to and require the use of the seat belt in accordance with the Consensus Standard ANSI B56.1-2012, Safety Standard for Powered Industrial Equipment, Section 5.3.19 which states: "An active operator protection device or system, when provided, shall be used." 2. Adhere to the manufacturer's warnings to wear seat belts when operating the equipment. 3. Enforce seat belt use during operation of powered industrial equipment.
