OSH ACT of 1970 Section (5)(a)(1): The employer is failing to furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees who operate the Toro Greensmaster 3100 series are exposed to potential permanent disabling injuries such as broken bones, or death as a result of crushed by hazards while performing landscaping and lawn mowing activities. The employer is failing to furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees such as crushed-by hazards. On August 31, 2019, at a worksite located at 3534 State Highway JJ, Moberly, Missouri 65270, the employer exposed employees to crushed-by hazards while operating a Toro Greensmaster 3100 Model: 04356 on or near a slope which was greater than 15 degrees. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: (1) Follow the Operator's Manual for the TORO Greensmaster 3100 Model: 04356, Page 5, "The operator must be skilled and trained in how to drive on hillsides. Failure to use caution on slopes or hills may cause loss of control and cause the vehicle to tip or roll, possibly resulting in personal injury or death." Page 9, Number 2, "Tipping hazard--do not use the machine on a slope greater than 15 degrees." (2) Train employees who operate the Toro Greensmaster 3100 series on how to safely operate the mower on or near slopes less than 15 degrees. (3) Conduct a hazard assessment of the golf course to determine areas that are on or near slopes that are greater than 15 degrees. Train the employees to avoid these areas when operating the Toro Greensmaster 3100 series. (4) Provide mowing equipment that has a Roll-Over Protection Structure (ROPS) equipped, and/or equipment approved for use on slopes greater than 15 degrees. Train employees to use only the approved equipment to mow on or near slopes greater than 15 degrees.
