OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush/struck hazards: a) In the elevator interior there was not a interior gate/door to protect employees from being caught/struck by steel beams and the elevator shaft projections as the elevator was moving up and down. Location: 304 Boerum Street, Brooklyn NY On or about 8/2/2019 AMONG OTHER METHODS AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Follow ANSI/ASME A17.3-2002 Safety Code for Existing Elevators, Section 3.4.2(a) which requires that elevator cars shall have a car door or gate provided at each entrance. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
