Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: a) On or about July 23, 2019, an employee was exposed to the hazard of being struck-by and/or crushed while working near and around the Volvo ECR-235D excavator while perform demolition work. Among others, feasible and acceptable methods of abatement to correct this hazard include, but are not limited to the following: (1) Conform to the Association of Equipment Manufacturers for Hydraulic Excavators and keep the bystanders away. (2) Conform to the Operator's Manual for Volvo ECR-235D Excavator and prevent persons from entering or remaining in the danger area, that is a distance of at least 7M (23 ft) in all directions from operating machines. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
