Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On July 19, 2019, a driver/operator was driving a Polaris XP1000 Utility Terrain Vehicle (UTV), along with four riders/workers, downhill on an unpaved road. The driver lost control of the vehicle which caused it to roll-over and resulted in a fatality and injuries to the four workers. The employer did not instruct UTV drivers/operators in recognition and avoidance of site-specific unsafe conditions while operating the UTV prior allowing the drivers to operate the vehicles.
