OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat: Instances: a. On or about June 21 2019, at the Wellington, FL UPS route, employees engaged in courier services were exposed to the hazard of high ambient temperatures and working in direct sunlight, which produced Wet Bulb Globe Temperatures (WBGT) ranging from 87.50 degrees Fahrenheit to WBGT 91.0 degrees Fahrenheit (Heat Index ranging from 98.9 degrees to 104.7 degrees Fahrenheit). Such exposures may lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, heat stroke, and death. b. On or about July 11 2019, at the Southern Boulevard and Royal Palm Beach, FL UPS route, employees engaged in courier services were exposed to the hazard of high ambient temperatures and working in direct sunlight, which produced Wet Bulb Globe Temperatures (WBGT) ranging from 77.18 degrees Fahrenheit to WBGT 86.9.0 degrees Fahrenheit (Heat Index ranging from 83.66 degrees Fahrenheit to 108.68 degrees Fahrenheit). Such exposures may lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, heat stroke, and death. Among other methods, a feasible and acceptable method of abatement includes, but it is not limited to, ensuring that all employees are trained on UPS's Cool Solutions heat stress management program and that UPS ensures the program is followed. Training should include the health effects associated with heat stress, symptoms of heat-induced illnesses, methods of preventing such illnesses, and actions that should be taken in the event a heat-induced illness is experienced, including the appropriate time to arrange for immediate medical attention.
