29 CFR 1910.178(l)(5) as referenced by 1926.602(d): Where an operator has previously received training in a topic specified in paragraph (l)(3) of this section, and such training is appropriate to the truck and working conditions encountered, the operator had not been evaluated and found competent to operate the truck safely. a) Intersection of Parkway Drive/Merritts Avenue NE: On or about June 6, 2019, and at times prior, employees were exposed to struck-by hazards, in that the employer did not evaluate the competency of an employee operating a JLG forklift truck model 10054 (serial number 0610087797) prior to its use.
