OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about May 22, 2019 - Mainline A ES Pallet "Kickout" Repair Area, employees were not protected from struck-by hazards when they were required to repair the rotate handle on a pallet on the conveyor while the pallet was not secured in place. Among other methods, one feasible and acceptable method to correct these hazards would be to (1) create a procedure utilizing a hoist to remove a pallet in need of repair or maintenance from the conveyor; (2) using the hoist, lower the pallet onto a table or stand; (3) secure the pallet to the table or stand during repair or maintenance; (4) return the pallet to the conveyor using the hoist; and (5) create a work rule prohibiting positioning one's body below the pallet during repair or maintenance.
