OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees 29 CFR 1910.23(c)(4): Ladders were not used on stable and level surfaces and were not secured or stabilized to prevent accidental displacement: �On or about May 28, 2019, during the relocation of a grain bin, an employee worked from an unstable extension ladder positioned on a moving vehicle and positioned himself on top of the grain bin and was not protected from a fall of approximately 23.8 feet. �Among other feasible and acceptable methods of abating the hazards and eliminating the need to access the ladder or top of grain bin are: (1) relocating the grain bin by using a millwright to disassemble the grain bin at one location and reassemble the grain bin at a second location; or (2) contracting with the local electric utility to relocate any electrical wires impeding passage of the grain bin on a public road.� Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
