29 CFR 1910.28(b)(3)(ii): The employer did not ensure each employee is protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems. On May 18, 2019, the employer did not ensure that employees were protected from stepping into a hole less than 4 feet above a pit containing liquid of high temperatures, exposing employees to burns and associated injuries. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
