OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards: (a) The employer is failing to protect employees from struck-by hazards associated with working underneath loads. This was most documented during the inspection conducted on May 07, 2019 at a worksite located in "L Yard" of the Iowa Army Ammunition Plant at 17571 DMC Hwy 79, Middletown, IA 52638. An employee was working in an approximately 20 foot long by 7 foot depth trench while the excavator operator was back-filling behind the employee. While back-filling, a hydraulic line from the excavator failed, causing the excavator bucket to free-fall and strike the employee.that were causing or likely to cause death or serious physical harm to employees
