OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm to employees. a) Fabrication Area: On or about May 3, 2019, and at times prior, employees were allowed to stand near two unsupported sides of a structural base (frame) weighing a total of 3,968 pounds while a Skyjack SJ643TH telescoping forklift was being operated in close proximity, exposing employees to a struck-by hazard.
