29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: 306 Martin Luther King Blvd., Newark, NJ a) The employer did not ensure that employees performing manual scrapping and demolition of interior walls and ceilings where lead containing paint was present had been informed of lead health hazards. On 5/6/19, employees performing interior manual demolition were exposed to lead at 65.0 ug/m3, 86.6 ug/m3 and 297 ug/m3 as an 8- hour Time Weighted Average (TWA), exceeding the Permissible Exposure Limit (PEL) of 50 ug/m3 by 1.3, 1.7 and 5.9 times, respectively. Zero exposure was assumed for unsampled periods of 271 minutes, 152 minutes and 139 minutes, respectively. b) The employer did not ensure that employees performing demolition of interior walls and ceilings where asbestos containing material (ACM) was present had been informed of asbestos hazards. Bulk samples of thermal pipe insulation from the 5th floor x-ray room and the 6th floor bathroom both contained 70 % asbestos. In addition, a bulk sample of wall board from 3rd floor add on room to porch contained 15 % asbestos. Violation occurred on or about 5/2/19 and 5/6/2019
