29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. (a) North, fabrication, AccurShear no. 637510 hydraulic shear: on or about March 13, 2019, the employer did not protect each employee in its regular production fabrication work tasks from the caught-in between hazards at the unguarded point of operation by the use of adequately adjusted guarding devices or other necessary means. Employees had their fingers exposed to caught in-between amputation hazards on the shear when hand-feeding and aligning metal parts in the unguarded point of operation for regular shearing fabrication tasks where the hold downs and the blade were accessible during normal operation. There is no abatement certification or documentation required for this item. (b) South, fabrication, Wysong hydraulic shear: on or about April 2, 2019, the employer did not protect each employee in its regular production fabrication work tasks from the caught-in between hazards at the unguarded point of operation by the use of adequately adjusted guarding devices or other necessary means. Employees had their fingers exposed to caught in-between amputation hazards on the shear when hand-feeding and aligning metal parts in the unguarded point of operation for regular shearing fabrication tasks where the hold downs and the blade were accessible during normal operation. There is no abatement certification or documentation required for this item.
