29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about March 6, 2019, and at times prior thereto, employees were exposed to a struck-by hazard while standing beneath and to the side of the XCMG XE2110 excavator bucket after removing wire rope from a cement block. b) On or about March 6, 2019, and at times prior thereto, employees were exposed to a struck-by hazard while constructing a cement block retaining wall without an inspection of the rigging elements used. c) On or about March 6, 2019, employees were exposed to struck-by hazards while constructing a cement block retaining wall with the operator of the XCMG XE2110 crawler excavator machine not activating the safety switch for the bucket control lever.
