29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors from sources such as open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks; spontaneous ignition, including heat-producing chemical reactions; and radiant heat: On or about March 4, 2019, and at times prior thereto, at the tank battery train #7, employees performed maintenance and/or repairs to a level controller/float on the heater treater oil boot and peanut valve and the employer did not prohibit spark producing equipment and tools such as but not limited to: a) a Skyjack, Model SJ45T, Serial No. 98001300; and b) a Crescent wrench and other tools which were not approved for the hazardous locations.
