29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. Rear Yard, Ferrous Metal Burn Area - The employer did not provide an employee with a medical evaluation for required respirator use. The employer required this employee to wear air-purifying 3M" Half Facepiece Reusable Respirator 6300/07026 with 3M 2097 P100 filters. An employee, who was performing torch burning of ferrous metal scrap, was exposed to 8-hour Time Weighted Average (TWA) of 0.8550 milligrams per cubic meter of airborne lead during a 384 minutes occupational exposure. The 8-hour TWA employee exposure was 17.1 times the OSHA Permissible Exposure Limit (PEL) of 0.050 mg/m3. The violation was noted on March 7, 2019.
