Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) Roadway in front of Lot 210 and 211, Haslet Road, Governors, Lewes, DE: On or about February 19, 2019, employees were exposed to struck-by hazards created by vehicular traffic while performing sewer inspection and testing operations in the east bound travel lane of a partially completed road. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to ensure all workers who must occupy the right-of-way to conduct operations establish Traffic Control Zones and wear a high visibility vest in accordance with Section 6 Temporary Traffic Control of the Federal Highway Administrations Manual on Uniform Traffic control Devices, 2009 Edition with Revision Numbers 1 and 2 incorporated , dated May 2012 and ANSI/ISEA 1072004 publication entitled American National Standard for High-Visibility Safety Apparel and Headwear (see Section 1A.11), or equivalent revisions, and labeled as meeting the ANSI 107-2004 standard performance for Class 2 or 3 risk exposure.
