29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. a. On or about February 13, 2019, at the worksite, employees cutting concrete using a circular saw with an abrasive blade and a shop vacuum to capture the resulting dust were over-exposed to silica dust at 1.6 times OSHA's Permissible Exposure Limit of 50 micrograms per cubic meter of air for an 8-hour time weighted average. The employer had provided Moldex 2300 N95 respirators for the employee's use without first ensuring that employees were medically able to safely perform work while wearing a respirator.
