Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an asphyxiation hazard: (a) Store Room (South Side) - On December 11, 2018, the employer failed to provide adequate general air ventilation in this room where two recently purchased forced air heaters, powered by diesel fuel were running, contaminating the air with toxic concentrations of the combustion products of diesel, resulting in the asphyxiation and consequential in-patient hospitalization of an employee. One feasible and acceptable means of abatement would be to follow the User's Manual & Operating Instructions for the Remington Kerosene Forced Air Heater, to include but not limited to adhering to the Danger warnings against the use of the equipment in enclosed spaces without adequate ventilation.
