OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to immersion and drowning hazards. a.) On November 16, 2018, the employer did not ensure employees were protected from immersion and drowning hazards in that the guarding on the manure pit was inadequate. An employee was using a 316Gr John Deere skid steer with a tire scraper attachment to push manure into the pit when he drove through the gate into the pit, sustaining fatal injuries. Among other methods, an abatement method would be to follow the guidelines in the American Society of Agricultural and Biological Engineers (ASAE) EP470 JAN1992: Manure Storage Safety 5.1.5 to design and construct a barrier strong enough to stop a slow moving tractor and skid loader.
