29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. A) 572 Ryders Lane East Brunswick, NJ 08816 Employees performing debris cleanup on a roadway, were exposed to the hazard of being struck by when working and walking in areas where the Kobelco SK135SRLC-1E Excavator with damage and/or disrepair was being operated. The Kobelco SK135SRLC-1E Excavator serial number YH04-03250 was operated with the following damage and malfunctioning devices: broken off/missing rear view mirrors, broken front window, and dirty windows in the operator's cab Abatement Note: General methods of control applicable for the circumstances include, but not limited to the following: 1) Follow operators manual pg 1-5: As per the Kobelco SK135SRLC-1E Excavator operator's manual a pre-start inspection should be performed. If any problems are found, repair or replace defective components immediately. Do not operate the machine until all problem areas are repaired. Always keep the windshield, working lamps, and mirrors clean for good visibility. Occurred on or about 10/19/18
