29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazards exist, the atmosphere in the excavation was not tested before employees entered excavations greater than 4 feet (1.22m) in depth: The employer is failing to ensure employees are protected from potential asphyxiation hazards while a gasoline powered generator was being used to power a water pump which is being used to remove water from the excavation. This was most recently documented at 150th St, and Capehart Rd., Springfield, Nebraska on or about October 18, 2018 when the employer had employees working in a 20 foot deep excavation with no form ventilation to help remove the gases from the excavation. Employees are potentially exposed to carbon monoxide fumes from the exhaust of the pump settling in the excavation. The employer had employees working in an excavation with no form of ventilation to prevent the buildup of carbon monoxide in the excavation.
