29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure: (a) Luis Ortiz Roofing, at 425 Wood Road, Snowmass Village, CO: On 8/27/18, the employer did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure Employees were re-roofing a four story condominium complex. An employee fell from the fourth story roof. This area was not provided with a guardrail system or safety net system. The employer did not ensure that the employee was protected by a personal fall arrest system. This condition exposed the employee to an approximate 40 foot fall hazard.
