29 CFR 1910.134(d)(1)(iii):Where the employer could not identify or reasonably estimate the employee exposure to respiratory hazard(s) in the workplace, the employer did not consider the atmosphere to be IDLH: a) At the facility, on or about August 17, 2018 and times prior to, the employer did not determine the atmosphere to be IDLH and did not conduct a reasonable estimate of employees exposure when an employee opened tanks such as, but not limited to, ethylene dichloride in tank T-14127; exposing employees to inhalation and asphyxiation hazards. b) At the facility, on or about August 14, 2018 and times prior to, the employer did not determine the atmosphere to be IDLH and did not conduct a reasonable estimate of employees exposure when employees opened tanks such as, but not limited to, dichlorophenol in tank T-102; exposing employees to inhalation and asphyxiation hazards.
