Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Jobsite - On or about July 10, 2018, the employer did not ensure that employees working around a Kubota Brand Super Series KX161-3 Excavator (S/N: 0721186, Model RFS5800/KX121161-35, U45-35) were not inside the working range of the excavator boom or bucket. Among other methods, one feasible and acceptable method to correct this hazard includes but not limited to the following: Ensure that all employees not otherwise in the cab of the Excavator are outside of the working range of the excavator boom and bucket, as directed by the owner's manual for the Kubota Brand Super Series KX161-3 Excavator. Additionally, at a minimum level, the operator should ensure that all employees are clear of the boom and bucket before operating the excavator, as prescribed in the Association of Equipment Manufacturer's Safety Manual for Operators and Maintenance Personnel in Mini-Excavators.
