29 CFR 1918.85(j)(3): The employer did not ensure that each employee exposed to a fall hazard was protected by a fall protection system meeting the requirements of 29 CFR 1918.85(k). Where the employer could demonstrate that fall protection for an employee would be infeasible or create a greater hazard due to vessel design, container design, container storage, other cargo stowage, container handling equipment, lifting gear, or port conditions, the employer did not alert the affected employee about the fall hazard and instruct the employee in ways to minimize exposure to that hazard: a. On or about July 31, 2018, at port side-bay 46 of the TOTE Isla Bella vessel, an employee fell from a 16 1/2 feet height and landed into the hold of the bay when signaling the crane operator to unload a 40 foot container with an incorrect twist lock. The existing guardrail in the area was missing the mid and top rails. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
