OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards. a) C & C Landscaping LLC, at the address of 9810 River Road, Milan, Ohio 44870: On or about July 16, 2018, employees operating a utility tractor near steep grades were exposed to roll-over hazards. An employee operating a Ford 3600 (s/n D3NN4024AD) tractor sustained fatal injuries when the tractor overturned into a ravine. The employer did not ensure that a seat belt was installed and used on the tractor which was equipped with a roll-over protection structure. Among other methods, one feasible and acceptable method to correct this hazard is to follow the guidelines in American National Standards Institute/ American Society of Agricultural and Biological Engineers (ANSI/ASAE) S478.1 FEB2012 (R2016), Roll-Over Protection Structures (ROPS) for Compact Utility Tractors by affixing a seat belt assembly to tractors equipped with ROPS systems. In addition, develop training procedures to ensure employees are aware of the hazards associated with roll overs and understand the importance of wearing a seat belt on tractors equipped with ROPS system and ensure employees do not operate a ROPS equipped tractor on or near slopes.
