OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing and/or struck by hazards: (a) Facility, 2138 Business 220, Bedford, PA: On or before July 12, 2018 three employees were riding in the vehicle at one time exceeding the manufacturer's limit of only two. In addition, the third employee was riding in the cargo bed which is prohibited by the manufacturer. The employee who was operating the vehicle attempted to park it and pressed the gas too hard causing the vehicle to traverse over an embankment. The employee in the passenger seat exited prior to the vehicle going over the hill; the employee in the cargo bed jumped out during the descend and sustained minor injuries; the employee operating the vehicle was seriously injured when the vehicle flipped, tossed him part way out and then landed on him.
