OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees working in the roadway were exposed to being struck by vehicles. On July, 11, 2018, an employee was struck and fatally injured by a passenger vehicle while performing survey work in the northbound land of a two lane rural township road with an unposted speed limit of 55 mph.
