Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employees in that the employee was exposed to getting struck-by and/or being crushed by Falling trees while in the process of tree felling operation: a. 212 Leak Lake Drive, Suwanee, GA (Private Residential Home) - Employees (Owner and Ground Crew) are exposed to struck-by hazard. The employer did not evaluate the area for hazardous condition such as, but not limited to dead tree limbs. In addition, the employer did not provide a rope that was long enough to prevent employees from working too close to the tree felling operations, on or about June 9, 2018. b. 212 Leak Lake Drive, Suwanee, GA (Private Residential Home) - Employees (Owner and Ground Crew) are exposed to struck-by hazard. The employer was not using the proper cut (undercut) method on several trees during the felling operations, on or about June 9, 2018. c. 212 Leak Lake Drive, Suwanee, GA (Private Residential Home) - Employees (Owner and Ground Crew) are exposed to struck-by hazard. The employer was not properly making a back-cut to the several trees during the felling operations; the cut was at a slab and in close proximity to the notch, on or about June 9, 2018. d. 212 Leak Lake Drive, Suwanee, GA (Private Residential Home) - Employees (Owner and Ground Crew) are exposed to struck-by hazard. The employer did not provide training to the new employee who was hired on the spot to work only for one day assisting in the felling/logging operation, on or about June 9, 2018. e. 212 Leak Lake Drive, Suwanee, GA (Private Residential Home) - Employees (Owner and Ground Crew) are exposed to struck-by hazard. The employer did not provide training certification records/documentations for the long-term employees operating in the logging/felling industry, on or about June 9, 2018. Among other methods, feasible and acceptable means of hazard abatement include: Ensure compliance with ANSI Zl33. l-2012 for Arboricultural Operations Safety Requirements, Section 8.5 regarding tree removal. The crew leader shall ensure appropriate cutting techniques and precautions are followed. The chain saw/ equipment operator or crew leader shall consider all relevant factors pertaining to the tree and site, and take appropriate actions to ensure a safe removal operations to include but not limited to: tree leans, tree decay, loose limbs, hangers, broken tops, chunks, or other overhead material. Provide education and training in the identification and removal of hazard trees and limbs. Provide education and training to on knots and ropes, rigging techniques, tree strength and weight characteristics, and potential electrical hazards.
