OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being a struck by equipment. On or about 14 March 2018, and at times prior thereto, the employer could not demonstrate its determination through a practical test that all operators had the skills necessary for safe operation of the equipment, including application of safe shut-down and securing procedures."
