29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or before March 9, 2018, the employer failed to initiate a safety program that addressed the commonly known hazards of trash chutes, this failure led to the victim attempting to manually clear the clog while standing on trash in the dumpster, resulting in the victim falling from the top of the dumpster.
