29 CFR 1926.453(a)(2): Aerial lifts may be "field modified" for uses other than those intended by the manufacturer provided the modification has been certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification. The employer is failing to ensure that any form of "field modification" to an aerial lift is approved by the manufacturer in order to prevent failure of the unit. This was most recently documented at 265 N. Showboat Boulevard. Hastings, Nebraska on or about January 26th, 2018, when an aerial lift was used to lift materials by wrapping a lifting sling around the knuckle of the boom and attaching it to a load. Employees were utilizing a Sunbelt Model 86-S to lift materials on the site without prior approval from the manufacturer to ensure this vehicle capable of this type of activity.
