29 CFR 1910.28(b)(7): The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling: Process Fuel Building- Employees cleaning saw dust in the Hog room are not protected from fall of approximately 10 feet through a wall opening where employees shovel the saw dust to the building exterior. The wall opening does not have guard rails to prevent a fall and employees are not required to wear personal fall arrest equipment when shoveling saw dust through the wall opening.
