29 CFR 1910.242(a): General requirements. Each employer shall be responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by employees. a) The employer had not ensured the safe condition of the hand held powered air driven portable tool in that a technician was using the tool with a cutting wheel attachment on December 12, 2017 without the required guard installed and incurred a sever laceration when the cutting wheel broke.
