29 CFR 1926.304(g)(1): The sides of the lower exposed portion of the blade of the saw were not guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contact with stock being cut to give maximum protection possible for the operation being performed: (a) Patriacca Construction, Inc. @ 10 Stonebridge Drive, Avon, Colorado 81620: On or before November 7, 2017, as part of the accident/injury prevention program under its safety program, the exposing employer did note ensure that the lower exposed portion of the blade was guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contact with the stock being cut to give maximum protection possible for the operation being performed. An employee used a Hitachi 10 inch miter saw to cut a Tyvek roll that was 12 inches in diameter. The employee manually retracted the blade guard to the highest upper position using his left thumb, thus circumventing the guard from coming down and making contact with material being cut. The saw kicked back, causing the employee's left thumb to come into contact with the unguarded portion of the blade, resulting in a deep cut of his left thumb. This condition exposed employees to amputation hazards.
