29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: A) Worksite - On November 20, 2017, and at times prior thereto, the employer did not develop and implement an emergency response plan (ERP) for employees responding to emergency response operations, such as but not limited to containment of uncontrolled releases of Category 2 or 3 flammable liquids. The employer did not fully develop and implement an emergency action plan (EAP) for employees evacuating the facility in the event of an emergency.
