29 CFR 1928.57(a)(11)(iii): Where a moving machinery part presented a hazard during servicing or maintenance, and the employer did not stop the engine, disconnect the power source, and stop all machine movement before servicing or maintenance was performed, the employer did not establish that the servicing or maintenance can be safely performed: (a) Milking Parlor - While performing servicing and maintenance work on the milking carousel, employees did not stop the machine and disconnect the power source, but rather laid underneath the moving carousel, which had a height above the parlor floor of 24.5 inches, exposing the employees to getting caught in or caught by moving machine parts, as happened on November 18, 2017, when an employee's sleeve got caught in a moving drive wheel for the south motor, resulting in a broken right forearm requiring surgery and hospitalization. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
