29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems, or personal fall arrest systems: On or about 4 October, 2017, at the above addressed jobsite, an employee was installing a blue tarp on a roof of a residential home without the use of fall protection, exposing the employee to a fall hazard of up to approximately 10-12 feet. IN THE ALTERNATIVE: 29 CFR 1910.28(b)(1)(ii): When the employer can demonstrate that it is not feasible or creates a greater hazard to use guardrail, safety net, or personal fall protection systems on residential roofs, the employer did not develop and implement a fall protection plan that met the requirements of 29 CFR 1926.502(k) and training that met the requirements of 29 CFR 1926.503(a) and (c): On or about 4 October, 2017, at the above addressed jobsite, an employee was installing a blue tarp on a roof of a residential home without the use of fall protection plan, exposing the employee to a fall hazard of up to approximately 10-12 feet.
