29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a. at the tank wash station, the employer did not conduct a pre-entry evaluation of a trailer tank containing sulfur residue to determine if the tank was a permit-required confined space. On or about 8/15/17, an employee entered a trailer containing sulfur residue without a permit and on his way out of the trailer, the employee lost consciousness and fell inside the trailer tank.
