Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Title 40.1-51.1.(a), Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that at the job site, Gum Swamp Bridge, Indian River Rd., Virginia Beach, Va., it was not assured that all employees were in the clear before swinging the bucket of the Link Belt LS-3400 hydraulic excavator. This caused an employee to be exposed to fatal crushing injuries resulting from being pinned between the excavator bucket and a 36" x 8' concrete pipe. "One feasible and acceptable abatement method, among others, to correct this hazard is to train employees to adhere to industry recognized practices as outlined in the Hydraulic Excavator User's Safety Manual as published by the Construction Industry Manufacturers Association that states in part "..Be sure everyone is in the clear before swinging or moving in any direction. NEVER swing or position attachment or load over ground crew or truck cab."
