29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: On or about September 2, 2017, and in times prior thereto, workers at the pipeline restoration project did not recognize the following conditions that exposed them to the hazard of being struck by a motor grader: a. Working within the 39.37 foot restricted area of a moving motor grader. Ref: page 29 of the Motor Grader operation manual. b. Pulling roots from the windrow placing themselves in the direct path of a motor grader and in blind spots of the grader. c. Wearing headphones or ear buds playing music while in the vicinity of a moving motor grader. Abatement note: 1) Train workers to stay outside of the 39.37 foot restricted area of moving motor graders. Ref: pages 28-29 of the Motor Grader operation manual. 2) Assign spotters to observe restricted areas and control pedestrian activity. 3) Frequently inspect the site and operations to ensure workers are not engaging in activities that can distract them from their surroundings.
