29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) D-Line: On or about September 14, 2017, employees conducting electronic disassembly were exposed to continuous noise at 66.07% of the permissible daily noise exposure (8-hour Time Weighted Average sound level of 85 dBA) during the 429 minute sampling period and were not included in the hearing conservation program. For a full eight hour work shift this exposure is equivalent to an average sound level of 87.0 dBA. Exposure calculations include a zero increment for the 51 minutes not sampled. b) D-Line to Glass: on or about September 14, 2017, employees conducting electronic disassembly and glass sorting were exposed to continuous noise at 97.85% of the permissible daily noise exposure (8-hour Time Weighted Average sound level of 85 dBA) during the 451 minute sampling period and were not included in the hearing conservation program. For a full eight hour work shift this exposure is equivalent to an average sound level of 89.8 dBA. Exposure calculations include a zero increment for the 29 minutes not sampled.
