40.1-51.1.(a) Code of Virginia: The employer did not furnish a place of employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: The passenger side rear step of a 1985 Dempster container truck on which employees stood while the truck was moving was worn and bent, thereby creating a slippery and unstable condition. On November 18, 1997, an employee received fatal injuries when he fell or was thrown from the step. One feasible and acceptable abatement method, among others, to correct this hazard is to implement a regular method of inspections of the steps and replace worn and bent steps before employees stand on and ride the steps.
