North Carolina General Statue 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees condition of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)The employer did not provide or assure the use of written procedures, checklists, and training in hazard recognition of every step in preparing the #3 power boiler for start-ups, fuel transfers, and operation to ensure that employees were not exposed to the accumulation of explosive vapors. One feasible and acceptable abatement method, among others, to correct this hazard is to provide employees with written procedures and/or checklists covering every step in preparing the #3 power boiler for start-ups, fuel transfer and/or switching operations, and hazard recognition training for boiler operation.
