OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while operating granulator equipment. a) On or about August 3, 2017, an employee operating the Rotogran granulator (model RO33336SP; s/n HP33369511115) sustained fatal injuries when the door and other internal parts were discharged/ ejected from the machine striking the employee. The employer did not ensure the machines components met the specifications of the original equipment manufacturer to keep the machine components from being discharged/ ejected from the unit.
